POLICIES OVERVIEW
PARKING POLICY
Sierra-at-Tahoe does not require parking reservations.
Parking is based on mountain capacity and is on a first-come, first-serve basis.
Sierra offers 6 parking lots, open to the public, lots A-F. Please expect to enter the parking lots this year as directed by our parking attendants, from the back access road. We will plan to fill the upper lots from A-D, then move into the lower lots, E + F. Exceptions will be made for those with a preferred parking pass.
Lots open daily at 7:00am. Please respect the direction of the parking attendants and expect to park tight.
Preferred parking is available daily for $35 or $269 for a Season parking pass offering priority parking access all season long. Access to preferred parking will be through the front of ‘C’ lot.
CANCELLATION POLICY
For any seasonal product—defined as any item valid for use the entire season—please view our Play It Forward Policy.
Reservations can be refunded or rebooked* within the current season if requested 2 days or more prior to your original arrival date. As an example, this means if you are arriving on Friday, your request MUST be received by 7AM Wednesday for a refund or rebook without a fee*.
Cancellation requests made with less than a 2-day notice are non-refundable but may be rebooked* within the current season with a $50 rebooking fee. Requests MUST be received by 11:59PM the day prior to your arrival to be rebooked*.
Changes to your dated reservation cannot be made on the day of your scheduled arrival and will result in the forfeiture of the product. This includes no-shows and late arrivals for lessons.
Cancellations must be requested via the form – link below – requests submitted by phone will not be honored.
*A product price difference may apply. There are no refunds if a lesser price. Tickets purchased through outside venders are non-refundable.

2025/26 PLAY IT FORWARD + DEFERRAL POLICY
We understand that plans change. If you need to defer your qualifying 2025/26 seasonal product for a resort credit to the 2026/27 season, please fill out the request form below before November 15, 2025. Please see program details below.
We hope this gives you more time to plan your season, and we look forward to seeing you
Deferral requests received by 11/15/2025:
- Season Pass and other seasonal products are non-refundable and non-transferable.
- Any qualifying 2025-26 seasonal product can be deferred for a resort credit to use during the 2026-27 season.
- Deferrals requested by 11/15/2025 for any reason will receive a resort credit for value paid , less the onsite ticket rate per day , for any days used from date of purchase through 11/15/2025. Any pass usage recorded after 11/15/2025 invalidates a deferral request.
- Resort credit will not be applied to a 2026-27 product until May 1, 2026. Resort credit cannot be redeemed for cash value and refunds will not be given for 2025-26 products of lesser value.
- The Play It Forward Guarantee is available for season products purchased for the 2025-26 season only and is not applicable for any extended products.
- If you choose to use your resort credit during the 2025-26 season, original purchase price will not be honored. Prices are based on the current rate at time of re-purchase, and you will be responsible for any price difference incurred. Refunds will not be given for a lesser value product.
Deferral requests received AFTER 11/15/2025:
- Season Pass and other seasonal products are non-refundable and non-transferable.
- In the case of documented medical reasons (a physician’s statement is required) that prevent the pass holder from skiing/riding for the remainder of the season, a resort credit may be issued. Medical conditions must occur prior to March 15, 2026 and Season Pass must not have been used after the initial symptoms to be eligible for any credit. Submit a Doctors note here.
- Days used will be charged the onsite ticket/program rate per day plus a processing fee of $50 per pass.
- Deferral requests do not extend to family members.
- Deferral requests must be received prior to 04/01/2026.
No refunds or credits will be given on season passes which are not picked up or unused . All rates subject to change without notice. 2025-26 Season Pass product eligibility is determined by passholder’s age as of November 1, 2025. Deferrals requested by 11/15/2025 for any reason will receive a resort credit for value paid, less the onsite ticket rate per day, for any days used from date of purchase through 11/15/2025.
Play It Forward Request
ANIMAL POLICY
Sierra at Tahoe Service Animal Policy Under the ADA, service animals are dogs (and in certain cases miniature horses) that are individually trained to perform tasks for people with disabilities, including but not limited to: guiding people who are visually impaired, alerting people who are hearing impaired, pulling wheelchairs, opening doors, alerting and protecting a person who is having a seizure, or performing other special tasks. Service animals are working animals, not pets, and no other types of animals, including what are commonly referred to as emotional support, comfort, or crime deterrent animals, qualify as service animals under the ADA. Service animals are allowed into all Sierra at Tahoe base area facilities where customers are normally allowed to go (miniature horses are evaluated on a case-by-case basis).
- Sierra at Tahoe does not permit service animals or pets on chairlifts. The only exceptions are trained (or in training) avalanche rescue dogs actively working with patrol or mountain safety staff and are accompanied by their handler. Avalanche dogs are specifically trained to ride chairlifts at very young ages. They typically train with the same ski patroller. The training takes over a year to complete and third-party accreditation is typically awarded upon completion.
- Service animals or other pets are not allowed on open ski trails, surface carpets, or on chairlifts due to safety concerns (e.g., the risk of injury to the animal, the unpredictability of dog behavior, the safety of other resort guests on trails below, emergency chairlift evacuation, and the safety of the guest who may lunge to stop / restrain a dog on a moving chairlift).
- No ski area in the U.S. allows dogs or service animals to run alongside their human who is skiing open trails. The U.S. Forest Service endorses this restriction due to legitimate safety concerns, including the potential for collisions with other guests and wildlife concerns.
The allowance of service animals at the resort is subject to two exceptions:
(1) the animal is out of control and the animal’s handler does not take elective action to control it; or (2) the animal is not housebroken.
A service animal shall have a harness, leash, or other tether, unless either the handler is unable because of a disability to use a harness, leash, or other tether, or the use of a harness, leash, or other tether would interfere with the service animal’s safe, effective performance of work of tasks, in which case the service animal must be otherwise under the handler’s control (e.g. voice control, signals, or other effective means)
PICNIC + BAG POLICY
No outside food or beverage is permitted inside any Sierra-at-Tahoe lodge facilities that provide restaurant services. Guests looking to eat their bag lunch may use Solstice Eatery for 30 minutes. Sierra-at-Tahoe has created several designated picnic areas for guests.
Designated Picnic Areas Include:
- Base Area – Mama’s Roof, Golden Bear Terrace, Solstice Plaza
- On-Mountain – Grandview Lodge Roof and Deck, Baja Grill Snow Beach
- Coolers and cooler bags are not allowed in lodge facilities that provide restaurant services.
- No outside alcohol is allowed in the resort or designated picnic areas
- Competition Teams Members may bring a bag lunch. They may eat them in the Competition Services room or in designated picnic areas.
Can I store my extra gear inside the lodge?
- Personal gear may NOT be stored inside the lodges.
- A limited number of day storage lockers are available. Extra gear can be stored inside your vehicle.
- All unattended bags will be consolidated in a designated area and tagged with the policy for educational purposes.
Enjoy the Tailgating Tradition
- Another popular option at Sierra-at-Tahoe is to use your vehicle as a base lodge. Take advantage of Tahoe’s 275 annual average days of sunshine to enjoy the vibrant tailgating scene in the parking lots.
DRONE / UAV POLICY
Photography is allowed across the resort and at all events. Please note, however, that drones and all other unmanned remote-controlled aircraft are not permitted to be flown anywhere on resort property for photography, video or any other use. This restriction includes aircraft that would be launched off-site but subsequently flown above resort property.
Violation of this policy may result in the suspension of your skiing / riding privileges at Sierra-at-Tahoe.
UPHILL ACCESS + USE POLICY
The Uphill Access and Use Policy outlines permitted uphill access at Sierra-at-Tahoe Resort. Uphill access is the use of the resort by means of skinning, snowshoeing, hiking, and running. This policy governs all terrain within the Sierra-at-Tahoe permitted boundary in which the resort is actively engaged in operations. Sierra-at-Tahoe and the United States Forest Service (USFS) encourage the use of public lands. Users should be aware that the public lands comprising Sierra-at-Tahoe are under a special use permit by the USFS.
General Rules Regarding Uphill Access
- All uphill users are required to have a Sierra-at-Tahoe Uphill Use Ticket or Season Pass product in their possession. Tickets and passes are available at the Season Pass office during the resort’s normal operating hours.
- Non-lift access at Sierra-at-Tahoe, such as uphill “skinning”, hiking, snowshoeing, may present high danger of personal injury to participants or others, and therefore may be limited or forbidden based on conditions, on-mountain activity and/or mountain policy.
- Uphill access is not allowed while pre-season mountain preparations are in progress, during low snow conditions when the resort or portions of it are not open to the public; during avalanche mitigation work, and/or during other resort operational work impacting public areas.
- All uphill users are required to read and sign an Uphill Access release of liability prior to pass issuance or uphill access.
- Users must abide by the rules and regulations established by Sierra-at-Tahoe and USFS when accessing Sierra-at-Tahoe for uphill access.
- All uphill users must adhere to and obey all posted information and be aware of trail closures and other operational considerations. Snowmobiles, snowcats, winch cat cables, snowmaking hoses, and other equipment may be encountered at any time.
- All users accessing resort trails or permitted areas at any time, with or without a ticket/pass, assume ALL RISKS OF INJURY OR DEATH associated with uphill access.
- At all times it is prohibited to approach within 100 feet of grooming machines, snowmobiles, winch cats, winch cables (stationary or moving), or snowmaking equipment including but not limited to fan guns, high pressure water lines, and high voltage electrical cables.
- Headlamps are required and must be turned on during dark or twilight hours. Reflective clothing is recommended.
- If the resort staff feels that users are presenting a hazard or are impeding operations the user will be asked to leave the resort.
- The use of terrain parks and terrain park features is prohibited by uphill users.
- Medical response, first aid, and transport off the mountain is not available after the resort closes for normal operations. Users must understand that they are responsible for their own rescue. Call 911 in the event of an emergency and be aware rescue may take time to arrive.
- Dogs are not permitted.
- Users must understand and accept that resort personnel may be performing maintenance on chairlifts and that chairlifts may be running. At no time should uphill users board a chairlift, running or not.
- Use of Terrain Park features is prohibited outside of normal operating hours.
- Obey all pertinent signage.
- Position yourself so that you are visible from above.
- Uphill access may be closed at any time during periods of inclement weather or while avalanche mitigation operations are underway.
- Snowmaking hoses –Warning, high pressure. Do not ski over snowmaking hoses.
- Electrical cords – Danger. Do not walk or ski over electrical cords. They are 480 volts or greater and are live even when snow gun is not operating. In general, avoid traveling between snowmaking machinery and the tree line.
- Stay away from hydrants. While in use they will not have pads on them.
- Snowmobiles – Stay away from snowmobiles and if you see one make yourself visible.
- Snow Cat Grooming Machines – Give Snow Cats a wide berth and make yourself visible to operators. Do not assume they can see you. Do not ski down directly behind grooming machinery in the fresh corduroy.
- Winch Cat Operations – Dangerous cable. Winch Snow Cats attach to cables to groom on steep slopes. Such work will involve cables stretched tight across the terrain on the slope and above the slope. This is very dangerous. Under no circumstance may anyone access any area within the resort where winch cat operations are taking place. Skiing into them can result in serious injury or death. Winch cables are known to move in any direction and can jump multiple feet into the air when in use. IF YOU SEE A FLASHING BEACON DO NOT TRAVEL BEYOND IT OR GO NEAR IT.
- Other hazard areas, operations or conditions may exist on the mountain including but not limited to the following risks: collisions with other skiers or riders, natural and manmade objects, trees, rocks, fences, lift towers, snowmaking equipment, over the snow vehicles such as snowmobiles or grooming equipment, unfinished grooming activity, loss of control, variations in terrain and snow conditions, bare spots, bumps, moguls, ice, stumps, forest growth and debris, erosion control devices, terrain park features, walking on the resort property and parking lots.
- Sierra at Tahoe is a mountain environment that requires your alertness, common sense and caution. Read and obey all signs. Be sure your physical condition permits you to hike, ski, snowboard, skin or otherwise use resort facilities. Be aware that high elevation can accentuate existing health problems and concerns.
Uphill Access Hours of Operation
- Uphill access is available before or after normal daily operations only.
- Uphill access is available until 8:00 a.m. and after 5:00 p.m.
- Uphill access is prohibited during normal resort operating hours.
- Uphill access is only allowed on designated trails.
- Freestyle Terrain Park usage is not allowed.
- Pre-season access is not allowed due to snowmaking and grooming operations.
- Post-season access is not allowed due to mountain operations such as road plowing
You MUST sign a release of liability to participate in uphill travel.
Only the below runs/routes are available for uphill access. All trails other than those specified above are CLOSED to uphill traffic. You must come down the same way you go up.
When uphill access is allowed, users must remain near the center of the trails and use the same route to return to the base area used to travel uphill.
People traveling uphill must not impede or obstruct ski area operations at any time.
Proper ski retention devices are required.
From the base area:
- Sugar ‘n’ Spice from the base of Grandview Express to the top of Grandview Express.
- Broadway beginning at the base of Easy Rider Express to Lower Sleighride to Echo
- Broadway beginning at the base of Easy Rider Express to Lower Sleighride, Escape, to the top of Westbowl Express.
From the base of Westbowl
- Marmot beginning at the base of Westbowl Express.
- Snowmobiles are prohibited at all times on Sierra-at-Tahoe resort property.
- Be advised, snowmobile operations may be underway by resort personnel. Stay away from all snowmobile traffic.
Use of sliding devices, including but not limited to, sleds, tower pads, plastic sheets, or plastic discs and the like are strictly prohibited.
- There is no charge for the pass.
- All persons are required to sign the Uphill Access Policy Release of Liability before accessing the mountain.
- Persons travelling uphill without having signed the access and use policy release of liability will be asked to leave the resort.
Signing in person is available in advance at the Sierra-at-Tahoe pass office during normal business hours.
MARIJUANA USE POLICY
FAQ on Proposition 64 and Question 2:
What you need to know about the legalization of marijuana use in California and Nevada when you visit ski resorts in both states.?What did these initiatives do?
Both initiatives make it lawful for individuals 21 years of age or older to consume marijuana in a private home or authorized business location.
Does the passing of these initiatives mean you can possess or consume marijuana at California and Nevada ski resorts?
No, for several reasons.
- Most ski resorts in California and Nevada are located on U.S. Forest Service land. The federal government regulates drugs through the Controlled Substances Act (21 U.S.C. § 811), which prohibits the possession and use of marijuana on federal land. Therefore, possession or use of marijuana at ski resorts on federal land (or any federal land) is against the law. Violators are subject to a minimum $1,000 fine and/or up to one year in prison (21 U.S.C. § 844). Repeat violators face stiffer penalties.
- Despite the new laws, it remains illegal to consume marijuana in all public places in California and Nevada. Every ski resort in both states is a “public place,” and therefore consuming marijuana is not permitted, even in currently designated smoking areas. This includes every location at a ski resort, including all facilities, trails, off piste areas, chairlifts, gondolas, lift lines, and parking lots.
- Marijuana impairs your senses. Skiing, snowboarding, and other recreational activities at ski resorts are athletic activities that require dexterity, skill, and awareness. Participating in these activities while impaired is neither safe for you nor those enjoying the activities with you.
Do all ski resorts have specific policies about using marijuana?
Yes. Please check each resort’s website or ask resort personnel if you have any questions. In short, do not possess or use marijuana illegally at any California or Nevada ski resorts or you will be subject to ejection, arrest, and/or prosecution.

Transfer of Personally Identifiable Information
As Booth Creek or any of its resorts continue to evolve, we may buy other businesses or their assets or sell our business assets. Customer information is generally one of the business assets involved in such transactions. Thus, in the event that Booth Creek, one of its subsidiaries or substantially all of were acquired, customer information would be one of the transferred assets. In addition, Booth Creek reserves the right to disclose user information in special cases when we have reason to believe that disclosing this information is necessary to identify, contact or bring legal action against someone who may be causing injury to or interference with (either intentionally or unintentionally) Booth Creek’s rights or property, other users, or anyone else that could be harmed by such activities. This includes our right to exchange information with other organizations in order to protect against fraud and to reduce credit risk. Booth Creek also reserves the right to disclose user information when we believe in good faith that the law requires it.

Sierra is committed to providing users a website that is accessible to the widest possible audience.
Sierra-at-Tahoe’s website has been developed considering the Web Content Accessibility Guidelines (WCAG) regarding ADA compliance rules and regulations. Our goal is to have our content accessible to all guests, including those who have various types of physical disabilities, vision loss, hearing impaired and limited dexterity to name a few.

- Photography / Images: We have implemented the use of “ALT” tags, or alternative text and “TITLE” tags for photography / images throughout our site. These tags provide a written description of the image for those who have images turned off in the browser. Inclusion of alternative text detail for images (task currently in progress).
- Accessible Forms: We have implemented the proper form controls and labels throughout this website to ensure all forms are logical and easy to use for people with all types of disabilities who use screen readers or keyboards. All forms fields follow a logical tab sequence to ensure easy navigation. Form fields also have ‘label’ and ‘id’ attributes to associate the form field with its label to allow for easy entry of data.
- PDF Documents: Our web team runs accessibility checks and reports on PDF documents that are listed on our website. If you have any issues accessing any PDFs or other documents on our site please contact our web team.
- Links: We style all the links on this website to display with underlines to clearly identify them as actual links.
- Font Size: The font sizes used on the website are fully flexible. You can change the font size to make it either larger or smaller via your browser settings.
- Video Closed Captions: Our team strives to use minimal animation and video throughout our website but it is present on some of our pages – and occasionally our front page. All video content can be found on our Sierra-at-Tahoe Mountain Resort YouTube channel and is closed captioned when applicable.
- Browser Support: The site is built in a flexible manner and scales to ensure readability on whatever device or browser it is viewed upon. Browser support is progressive meaning more capable browsers may get improved aesthetics or functionality, yet content is still accessible to even the oldest browsers.
- Semantics: HTML5 markup is used to structure the site with appropriate elements used to clearly and logically identify content for search engines or screen readers.
- JavaScript: The use of JavaScript will give the user enhanced features of the site. Where it is not available then all pages and process are still accessible.
- Downloads: We use Adobe PDFs for additional information and downloads. Adobe PDF Reader is freely available for use on any computer, and a link to the software has been provided where appropriate.

User Submissions Guidelines
Eligibility: We may permit written, photographic, video or other material to be submitted by you and other users (collectively, “User Submissions”) through the Site via e-mail or via any other means, and we may also permit the hosting, sharing, and/or publishing of such User Submissions. In order to submit a User Submission on the Site, you must be a legal resident of the 50 United States or the District of Columbia who is of legal age of majority in your jurisdiction of residence (and at least 18 years of age). You may be required to provide documentation in a form acceptable to us evidencing such rights. For example, the above grant permits Sierra-at-Tahoe® and its designees to use all or only certain portions of your User Submission, modify any audio tracks or visual images your provide, and/or incorporate other materials, either created by Sierra-at-Tahoe® or licensed from others, with your User Submission. If we create other works using your User Submission, those works will be owned by us and may be used in accordance with these Terms and Conditions, and shall not be subject to your approval. You also hereby grant each user of the Site a non-exclusive license to access your User Submissions through the Site, and to display and perform such User Submissions as permitted through the functionality of the Site and under these Terms and Conditions. You will not have any claim against us with respect to such use of the User Submissions, and to the extent, a claim is made against us or any of our licensees by any third party with respect to the User Submissions, you agree to indemnify and hold Sierra-at-Tahoe®, and its parent and affiliated companies, directors, employees, agents, representatives, lessors, licensees and contractors harmless with respect to any such claims, including, without limitation, attorneys’ costs and expenses incurred in connection therewith. You may request removal of a User Submission that has been posted on the Site by clicking here. After receipt of your request for removal, we will endeavor to remove the User Submission; however, we will have no liability to you or anyone else resulting from our failure or refusal to remove a User Submission. When you submit a User Submission, you understand that we will have the right, but not the obligation, to use, display and publish your name, photograph, likeness, voice, performance, biographical information and/or statements, throughout the world in perpetuity in any media that now exists or may exist in the future including for advertising and promotional purposes by Sierra-at-Tahoe® and its related entities. If we make use of any of the foregoing rights, you understand and agree that you shall not receive any other consideration, or payment, notification or credit, nor will you have any approval over how we use the foregoing rights.
Discontinuation and Modification of Acceptance of User Submissions: Sierra-at-Tahoe® reserves the right at any time and from time to time to discontinue, temporarily or permanently, the acceptance of User Submissions and/or your ability to access User Submissions with or without notice in its sole discretion. You agree that Sierra-at-Tahoe® shall not be liable to you or to any third party for any suspension or discontinuance of acceptance of User Submissions.
Referral Programs; Forward-to-a-Friend Opportunities
We may offer from time to time referral programs that permit you to submit information about other persons (each, a “ Referred Person ”), including, without limitation, email addresses, wireless telephone numbers, names, street addresses and other contact information so they may receive information and/or promotional offers concerning the Site and its features. We will use and store any such information that we collect from you about a Referred Person only to the extent necessary to carry out your request, and we will not use any such information for any other purpose unless the Referred Person consents to the use for such other purpose. You may only refer persons with whom you have a personal relationship. You must have obtained the consent of the Referred Person prior to providing us with his or her contact information. We reserve the right to limit the number of Referred Persons you can submit. We reserve the right to limit the number of transmissions to any particular Referred Person from time to time. If we send the confirmation to you via the carrier service with which you have a mobile communications subscription or otherwise have access, you understand you will pay any service fees associated with any such access (including text messaging charges for messages to your mobile device). UNDER NO CIRCUMSTANCES SHALL SIERRA-AT-TAHOE®, OR ITS RESPECTIVE PARENTS, SUBSIDIARIES, PARTNERS, REPRESENTATIVES, VENDORS, AGENTS, AFFILIATES, LICENSORS, SPONSORS AND ADVERTISERS BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL OR EXEMPLARY DAMAGES ARISING OUT OF THE USE, OR THE INABILITY TO USE, THE MATERIALS ON THIS SITE (EVEN IF SUCH PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), INCLUDING, WITHOUT LIMITATION, ANY LOST PROFITS, REVENUE, OR BUSINESS INTERRUPTION, OR LOSS OF COMPUTER PROGRAMS OR DATA ARISING FROM (I) YOUR USE OF OR INABILITY TO USE THE SITE, OR (II) CONTENT, PRODUCTS, AND/OR SERVICES INCLUDED ON OR AVAILABLE THROUGH THE SITE. SOME JURISDICTIONS DO NOT PERMIT THE EXCLUSION OF CERTAIN WARRANTIES OR THE LIMITATION OR EXCLUSION OF LIABILITY. YOU SPECIFICALLY ACKNOWLEDGE THAT SIERRA-AT-TAHOE® SHALL NOT BE LIABLE FOR USER SUBMISSIONS OR ANY ILLEGAL CONDUCT OF ANY THIRD PARTY AND THAT THE RISK OF HARM OR DAMAGE FROM THE FOREGOING RESTS ENTIRELY WITH YOU.
Indemnification
You agree to defend, indemnify and hold Sierra-at-Tahoe®, and its respective parent companies, subsidiaries, partners, agents, affiliates, lessors, licensors, representatives, sponsors and advertisers and their respective officers, directors, shareholders, agents, affiliates and representatives harmless from and against any and all claims, demands, liabilities, losses, damages, costs and expenses (including, without limitation, reasonable attorneys’ fees) arising from your breach of any warranties, representations and agreements set forth in these Terms and Conditions, including, without limitation, your unauthorized use of any Content (including the User Submissions).
Governing Law
THE PARTIES AGREE THAT THIS AGREEMENT, OR ANY CLAIM, DISPUTE OR CONTROVERSY (WHETHER IN CONTRACT, TORT, OR OTHERWISE, WHETHER PREEXISTING, PRESENT OR FUTURE, AND INCLUDING STATUTORY, COMMON LAW, AND EQUITABLE CLAIMS) BETWEEN YOU AND SIERRA-AT-TAHOE® arising from or relating to this Agreement, its interpretation, or the breach, termination or validity thereof, the relationships which result from this agreement, advertising by Sierra-at-Tahoe® , or any related purchase SHALL, TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BE GOVERNED BY THE LAWS OF THE STATE OF NEW YORK, WITHOUT REGARD TO CONFLICTS OF LAWS RULES.
Binding Arbitration
ANY CLAIM, DISPUTE, OR CONTROVERSY (WHETHER IN CONTRACT, TORT, OR OTHERWISE, WHETHER PREEXISTING, PRESENT OR FUTURE, AND INCLUDING STATUTORY, COMMON LAW, INTENTIONAL TORT AND EQUITABLE CLAIMS) BETWEEN YOU AND SIERRA-AT-TAHOE®, its respective agents, employees, principals, successors, assigns, or affiliates (collectively for purposes of this paragraph, “Sierra-at-Tahoe® “) arising from or relating to this Agreement, its interpretation, or the breach, termination or validity thereof, the relationships which result from this Agreement (including, to the full extent permitted by applicable law, relationships with third parties who are not signatories to this Agreement), Sierra-at-Tahoe® ‘s advertising, or any related purchase SHALL BE RESOLVED EXCLUSIVELY AND FINALLY BY BINDING ARBITRATION ADMINISTERED BY THE NATIONAL ARBITRATION FORUM (NAF) under its Code of Procedure then in effect (available via the Internet at http://www.arb-forum.com, or via telephone at 1-800-474-2371). The arbitration will be limited solely to the dispute or controversy between you and Sierra-at-Tahoe®. NEITHER YOU NOR SIERRA-AT-TAHOE® SHALL BE ENTITLED TO JOIN OR CONSOLIDATE CLAIMS BY OR AGAINST OTHER SIERRA-AT-TAHOE® CUSTOMERS, OR ARBITRATE ANY CLAIM AS A REPRESENTATIVE OR CLASS ACTION OR IN A PRIVATE ATTORNEY GENERAL CAPACITY. This transaction involves interstate commerce, and this provision shall be governed by the Federal Arbitration Act 9 U.S.C. sec. 1-16 (FAA). Any award of the arbitrator(s) shall be final and binding on each of the parties, and may be entered as a judgment in any court of competent jurisdiction. Sierra-at-Tahoe® will be responsible for paying any arbitration filing fees and fees required to obtain a hearing to the extent such fees exceed the amount of the filing fee for initiating a claim in the court of general jurisdiction in the state in which you reside. Each party shall pay for its own costs and attorneys’ fees, if any. However, if any party prevails on a statutory claim that affords the prevailing party attorneys’ fees, or if there is a written agreement providing for fees, the Arbitrator may award reasonable fees to the prevailing party, under the standards for fee shifting provided by law. Miscellaneous
These Terms and Conditions shall be binding upon and inure to the benefit of the parties hereto and their respective successors and assigns. If any provision of these Terms and Conditions is held to be invalid or unenforceable, such provision shall be modified or eliminated to the minimum extent necessary and the remaining provisions shall be enforced. These Terms and Conditions constitute the entire agreement between the parties hereto, and supersede any other agreement, promise, or practice between the parties relating to the subject matter hereto. We reserve the right to terminate your access to and ability to use the Site (or any portion thereof), at any time (with or without notice). No waiver by either party of any right hereunder shall constitute a waiver of this or any other right.
